PHONE / E-MAIL SUPPORT
(a) Services: LastPlaceToLook.com will attempt problem diagnosis and a solution over the telephone for an applicable fee. In certain cases, however, problem diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control.
(b) User Responsibility: You understand and agree that prior to contacting or allowing LastPlaceToLook.com to perform diagnostic repair on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives unless that service is requested at a previous time. You acknowledge and agree that LastPlaceToLook.com shall not be responsible under any circumstance for any loss or corruption of data and/or software.
IN-HOME / LOGMEIN SERVICE
(a) Scheduling: Standard service hours are Monday-Friday, 9 AM – 9 PM, Saturday 10 AM – 9 PM. Additional charges may apply for rapid response services or service outside of standard installation hours, unless predefined in an agreement with LastPlaceToLook.com.
(b) Service Jurisdiction: LastPlaceToLook.com sets the Service Jurisdiction for each city. If a location lies beyond LastPlaceToLook.com's standard Service Jurisdiction, additional trip charges may apply. To determine if your location is within the LastPlaceToLook.com standard Service Jurisdiction , please inquire at a LastPlaceToLook.com, visit Service Jurisdiction interface map or call 913.538.1520 for information pertaining to standard Service Jurisdictions and applicable trip charges.
(c) Additional Hardware or Software Install/Service: This service is only available to customers who have already purchased on-site service and are purchasing this as a second service. Approved services must be one of the following: software installation, software service, memory installation, sound/video card installation, network/modem card installation, CD/DVD-RW installation, or Computer installation.
(d) An Adult Must Be Present At Residences or Business: For on-site services, a person of at least 18 years of age must be present during the entire time period services are provided. IF THE LastPlaceToLook.com SERVICE AGENT ARRIVES AT THE SCHEDULED SERVICE TIME AND NO ADULT IS PRESENT, SERVICES MAY BE DENIED AND A CANCELLATION CHARGE MAY BE ASSESSED.
(e) BACKUP YOUR SOFTWARE AND DATA: IT IS YOUR RESPONSIBILITY TO BACK UP ALL SOFTWARE AND DATA THAT IS STORED ON YOUR COMPUTER'S HARD DISK DRIVE(S) AND/OR ON ANY OTHER STORAGE DEVICES YOU MAY HAVE PRIOR TO THE ARRIVAL OF THE LastPlaceToLook.com SERVICE AGENT TO YOUR HOME OR BUSINESS UNLESS THE SERVICE IS REQUESTED AT A PREVIOUS TIME. LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER SHALL NOT BE RESPONSIBLE AT ANY TIME FOR ANY LOSS, ALTERATION OR CORRUPTION OF ANY SOFTWARE, DATA OR FILES.
(f) Minimum System Requirements (For Wireless Home Networking Only):
- All computers to be networked must have a minimum of 40MB of hard disk space and 128 MB of RAM.
- Password(s) for operating systems(s) and/or ISP must be available at the time of service.
- Microsoft Windows XP operating system or greater.
- Operating System disc and Key Code must be available at the time of service.
- All computers and/or peripherals to be networked must be in good working order and Spyware-free.
- For all broadband installations, the broadband services must be installed and operational prior to the time of service, including connections to any broadband modem.
(g) Access: The LastPlaceToLook.com Service Agent must receive full access to the computer(s) and/or peripheral(s) to be serviced, access to your residence, your consent and cooperation to enter your residence or business, and a safe working environment, working space and electrical power. IF THE LastPlaceToLook.com SERVICE AGENT ARRIVES AT THE SCHEDULED SERVICE TIME AND DETERMINES THAT HE/SHE DOES NOT REASONABLY HAVE THE ACCESS, COOPERATION, OR SAFE WORKING AREA DESCRIBED IN THE PREVIOUS SENTENCE, THEN SERVICES MAY BE DENIED AND A CANCELLATION CHARGE MAY BE ASSESSED.
FEES AND RENEWALS
(a) Month-to-Month Subscription by Credit Card Only. In the event that Your subscription to the Service is on a monthly basis, payment of the subscription fee will be preauthorized credit card charge, PayPal charge or direct debit, and Your subscription will automatically renew each calendar month unless You or LastPlaceToLook.com give written (including email) notice of non-renewal during the prior calendar month. Your credit card will be charged the monthly fee for each month or partial month that Your monthly subscription is in effect.
(b) Annual Subscription by Credit Card. In the event that Your subscription will automatically renew at the begining of each subsequent anniversary year unless You or LastPlaceToLook.com give prior written (including email) notice of non-renewal at least 30 days prior to the expiration of Your current year subscription. Upon any annual renewal, the payment arrangements in place for the prior subscription year shall remain in place, unless You and LastPlaceToLook.com agree otherwise.
(c) Annual Subscription By Invoice. In the event that Your subscription to the Service is for a year and the initial payment is by check or bank draft against an invoice from LastPlaceToLook.com, payment being due within thirty (30) days' of the date of invoice. Additionally, Your subscription will automatically renew at the beginning of each subsequent anniversary year unless You or LastPlaceToLook.com give prior written (including email) notice of non-renewal at least thirty (30) days prior to the expiration of the current year subscription. Upon any annual renewal, the payment arrangements in place for the prior subscription year shall remain in place, unless You and LastPlaceToLook.com agree otherwise and LastPlaceToLook.com will invoice you accordingly.
(d) Credit Card Authorization. In the event that You or the Contracting Party cancel the credit card provided to LastPlaceToLook.com or the card is otherwise terminated, You or the Contracting Party must immediately provide LastPlaceToLook.com with a new valid credit card number. You and the Contracting Party authorize LastPlaceToLook.com, from time to time, to undertake steps to determine whether the credit card number provided to LastPlaceToLook.com is a valid credit card number. In the event that You or the Contracting Party do not provide LastPlaceToLook.com with a current valid credit card number with sufficient credit upon request during the effective period of these Terms, You and the Contracting Party will be in violation of these Terms.
(e) Payment via PayPal®. LastPlaceToLook.com also accepts PayPal for payments from PayPal account. In order to pay with PayPal, You or the Contracting Party need to have an account with PayPal. When You or the Contracting Party select PayPal to make payments the transaction is re-directed from LastPlaceToLook.com's site to PayPal's payment site. Once directed to PayPal's site, PayPal is charged with protecting Your and the Contracting Party's personal and financial information. Your or the Contracting Party's PayPal account and any activities related thereto are governed by PayPal's terms and conditions, and the information provided to PayPal in relation thereto will be governed by PayPal's privacy policy. When PayPal is used, Your and the Contracting Party's financial information is not shared with LastPlaceToLook.com. Once payment is complete via PayPal, PayPal will email a receipt for this transaction. LastPlaceToLook.com reserves the right to request proof of identity from any PayPal member.
(f) Payment Due. Unless specifically provided otherwise herein, payment of all fees are due and payable to LastPlaceToLook.com without demand, invoicing or notice before the commencement of the period to which those fees apply.
(g) Trial Offers, Coupons, Credits and Special Offers. LastPlaceToLook.com reserves the right to discontinue or modify any coupons, credits and special promotional offers at our discretion.
TERMS APPLICABLE TO PAY FOR SUPPORT AND IN-HOME SERVICES:
LIMITATIONS TO SERVICE: LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL SERVICES ORDERED AND INSTEAD REFUND THE CUSTOMER'S PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT THE MINIMUM SYSTEM REQUIREMENTS ARE NOT MET OR THE TECHNICAL NEEDS (INCLUDING WIRING OR OVERCOMING PHYSICAL OR TECHNICAL BARRIERS) OR OTHER REQUIREMENTS OF THE CUSTOMER ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER.
FORCE MAJEURE: If LastPlaceToLook.com's and/or its third party service provider's ability to render services is impaired by you or circumstances beyond the control of LastPlaceToLook.com and/or its third party service provider, LastPlaceToLook.com and/or its third party service provider may choose not to provide services.
LIMITATION OF REMEDY: UNDER NO CIRCUMSTANCES SHALL LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, EXPENSES COSTS, PROFITS, LOST SAVINGS OR EARNINGS, LOST OR CORRUPTED DATA, OR OTHER LIABILITY ARISING OUT OF, OR RELATED TO, THE SERVICES PROVIDED BY LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER OR OUT OF THE INSTALLATION, DEINSTALLATION, USE OF, OR INABILITY TO USE YOUR COMPUTER EQUIPMENT, HARDWARE, PERIPHERALS, OR THE NETWORK RESULTING FROM THE SERVICES PROVIDED HEREUNDER.
RELEASE OF LIABILITY: BY READING AND AGRREEING TO THIS UPON SIGN-UP, YOU AFFIRMATIVELY RELEASE AND HOLD HARMLESS BEST BUY, LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER FROM AND AGAINST ANY LOSS, LIABILITY, OR DAMAGE THAT YOU ROR THE OWNER OR LESSEE MAY SUFFER, INCLUDING BUT NOT LIMITED TO ANY LOSS OF ANY DATA AND THE NON-FUNCTIONING OF ANY COMPONENT OR ELEMENT OF YOUR COMPUTER EQUIPMENT OR PERIPHERALS RESULTING FROM LastPlaceToLook.com AND/OR ITS THIRD PARTY SERVICE PROVIDER'S AGENTS, PARTNERS AND/OR THIRD PARTY SERVICE PROVIDERS, REGARDLESS OF THE WARRANTIES, DISCLAIMERS AND WAIVERS PARTICULAR SERVICE AND SHALL CONSTITUTE LIQUIDATED DAMAGES AND ARE A REASONABLE ESTIMATE OF DAMAGES TO YOU.
CHANGES, CANCELLATIONS AND REFUNDS
To change your order you must contact LastPlaceToLook.com at 913.538.1520 or support@lastplacetolook.com.
You may cancel your In-House Service if you give LastPlaceToLook.com at least 4 hours notice prior to the scheduled performance of services. Cancellations must be completed by calling 913.538.1520. The payment amount will be fully refunded in the manner the purchase was paid.
If you are not satisfied with your service: Please call 913.538.1520 for resolution. We stand behind our Phone/E-mail Support services for 5 days. We stand behind our In-Home Service for 30 days. If there is a problem with the service we provided and you notify us within the stated time period, we will work to remedy your problem quickly and at no additional cost.
